"הדין לעבודה פסק פיצוי כספי ניכר לעובד בן 63 שפוטר לאחר 29 שנות עבודה . בית הדין קיבל את טענת העובד כי פוטר מטעמי גיל ובחוסר תום לב וכי ההחלטה על פיטוריו התקבלה עוד בטרם נערך לו הליך של שימוע . בית הדין הדגיש את חובת תום הלב המוגברת המוטלת על המעביד וציין כי הוא צריך לבחון לא רק את צרכיו ושיקוליו של הארגון אלא גם את אילו של העובד ובמיוחד את גילו ואת העובדה כי הוא נמצא 3 שנים לפני גיל הפרישה . בית הדין דחה את טענת המעביד כי משרת העובד בוטלה או שלא ניתן היה למצוא לו תפקיד אחר וקבע כי לעובד היו יכולות רבות וניתן היה לשבץ אותו בתפקיד אחר במיוחד אחרי שהוכח שהעובד הודיע כי הוא מוכן לבצע כל עבודה , אפילו במשרה חלקית ובשכר מופחת . לאחר שקיבל את טענות העובד פסק לו בית הדין פיצוי בסך 50,000 ש"ח בגין פיטורין בניגוד לחוק שוויון הזדמנויות בעבודה, פיצוי בסך 50,000 ש"ח בגין אי קיום חובת השימוע ופיצוי בסך 190,000 ש"ח בגין פיטורין בחוסר תום לב ועגמת נפש . בנוסף פסק לעובד 30,000 ש"ח כהוצאות משפט . בסך הכול זכה העובד בסכום של 320,000 ש"ח . "
